Terms and Conditions for Gardeners Sudbury
Gardeners Sudbury provides professional gardening services subject to the following terms and conditions. By booking, confirming, or allowing work to begin, the customer agrees to these terms in full. These conditions are designed to set out how bookings are made, how payment is handled, what happens if appointments change, and the responsibilities of both parties throughout the service relationship.
This document applies to all domestic and light commercial gardening work carried out under the name Gardeners Sudbury, unless a separate written agreement states otherwise.
For the purposes of these terms, “customer” means the person requesting the service, and “we”, “us”, or “our” means the gardening service provider. The service may include routine maintenance, planting, lawn care, hedge trimming, clearance, and related garden work. All work is carried out with reasonable skill and care, using appropriate methods and equipment for the agreed task. These terms are intended to be fair, practical, and consistent with standard UK service practices.
Gardeners in Sudbury may occasionally need to adjust scheduling due to weather, access issues, safety concerns, or unforeseen operational matters. Where this occurs, reasonable efforts will be made to rearrange the visit at a mutually convenient time.
Any changes will be handled in good faith and with as much notice as reasonably possible.
1. Booking Process
Bookings may be made after an enquiry and are only confirmed when both sides agree the scope of work, approximate timing, and any material conditions relevant to the job. A booking is not guaranteed until it is accepted, and acceptance may be dependent on availability, access, weather, and the nature of the requested work. The customer should provide accurate information about the garden, the tasks required, any hazards, and any special instructions before the appointment is finalised.
When a booking is arranged, the customer is responsible for ensuring that the service description is complete and accurate. If the work required changes on arrival, we may revise the scope, price, or timing. In some cases, the revised work may need to be scheduled separately. Gardeners Sudbury reserves the right to decline work that is unsafe, impractical, or materially different from what was agreed. Access must be available at the agreed time, and the customer must ensure gates, paths, and relevant work areas are reasonably clear.
We may request photographs, written instructions, or a site visit before confirming larger or more complex jobs.
This is to ensure the work can be priced and scheduled correctly. Where a booking is made for recurring maintenance, the service may be subject to periodic review to reflect seasonal requirements and the condition of the garden.
2. Prices and Payments
Prices may be quoted as a fixed fee, an hourly rate, or a regular maintenance charge, depending on the job. Unless stated otherwise, all prices are quoted in pounds sterling and may be subject to change if the scope of work changes. Any estimate is based on the information provided at the time and is not binding if the actual work differs significantly from the original description. Extra work will only proceed with the customer’s agreement where reasonably possible.
Payment terms will be confirmed at the time of booking. Payment may be required on completion, in advance, or in part before materials are purchased, depending on the service type. If an invoice is issued, it should be paid by the due date stated on the invoice. Late payment may result in suspension of further services until all outstanding sums are cleared. Where a payment fails, is reversed, or is otherwise not received, the customer remains liable for the full amount due.
Any materials purchased specifically for the job, such as plants, compost, soil, waste bags, or replacement items, may be charged separately unless agreed otherwise in writing. Gardeners Sudbury may also charge for disposal costs where these are directly linked to the service and have been explained in advance. The customer is responsible for ensuring they have authority to approve any additional charges relating to the agreed work.
For recurring or large-scale garden maintenance, we may require a deposit or staged payments. Deposits secure scheduling and help cover preparatory costs. Unless stated otherwise, deposits are non-refundable once work has been reserved, administrative time has been allocated, or materials have been ordered.
If a customer disputes an invoice, they should raise the issue promptly and in writing so that it can be reviewed fairly.
3. Cancellations, Rescheduling and Missed Appointments
The customer may cancel or reschedule a booking by giving reasonable notice. If notice is short, a cancellation charge may apply to cover reserved time, planning, and any costs already incurred. The amount of any charge will depend on the level of preparation completed and the notice provided. Where possible, rescheduling will be offered as an alternative to cancellation.
If the customer is not present and access is unavailable at the agreed time, or if the work cannot proceed because the site has not been made ready, the appointment may be treated as a late cancellation or a wasted visit. In such circumstances, a call-out or minimum booking charge may apply. The same may apply where key information has been withheld and the work cannot safely continue. Gardeners in Sudbury will act reasonably, but repeated missed appointments may lead to refusal of future bookings.
We may need to cancel or reschedule due to illness, unsafe conditions, severe weather, equipment failure, or other matters beyond our control. If this happens, we will aim to give as much notice as possible and suggest a new date. If a job must be paused for safety or practical reasons, the customer will only be charged for the work already completed and any non-recoverable costs that were clearly necessary for the service.
4. Liability and Customer Responsibilities
We will take reasonable care when working on the customer’s property, but gardening work can involve inherent risks, especially where tools, machinery, uneven ground, hidden debris, roots, damp surfaces, or restricted access are involved. The customer must keep children, pets, and visitors away from work areas while work is in progress. Gardeners Sudbury is not responsible for injury, loss, or damage arising from unsafe site conditions that were not reasonably foreseeable or were not disclosed in advance.
The customer must inform us of any underground services, fragile structures, wildlife constraints, or known hazards that might affect the work. This includes irrigation systems, cables, pipes, concealed fixtures, unstable paving, protected plants, or areas that should not be disturbed. If the customer asks us to work near such items, they accept that limited risk may remain even when reasonable care is taken. We are not liable for pre-existing defects, natural settlement, or wear and tear that becomes apparent during normal garden work.
Where we recommend a particular method, the customer remains responsible for deciding whether to proceed with the requested service. If the customer asks us to carry out work against our advice, they do so at their own risk to the extent permitted by law. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under UK law.
To the fullest extent permitted by law, our total liability for any claim arising out of the service will be limited to the amount paid, or payable, for the specific work giving rise to the claim. We will not be liable for indirect or consequential losses, including loss of profit, loss of enjoyment, or business interruption. This limitation does not affect statutory rights where they apply.
5. Waste, Green Waste and Disposal Regulations
Waste generated during gardening work must be handled in accordance with relevant UK waste rules and environmental obligations. Green waste, cuttings, soil, branches, and similar materials may be removed, composted, recycled, or left on site depending on the agreed service and the practical arrangement for the job. Gardeners in Sudbury will not dispose of waste in a way that breaches legal requirements or creates unnecessary environmental harm.
Unless otherwise agreed, the customer is responsible for confirming whether waste should be taken away or left for on-site composting or collection. If waste is to be removed by us, additional charges may apply for labour, transport, segregation, and disposal fees. Waste may only be handled by licensed or appropriately authorised facilities where required. We may ask the customer to confirm the desired disposal method before work starts.
The customer must not ask us to remove hazardous, prohibited, or specialist waste unless this has been specifically agreed and can lawfully be handled. This includes, but is not limited to, asbestos, chemicals, oils, contaminated materials, clinical waste, gas canisters, or items not arising from ordinary garden work. If such materials are discovered during the service, work may be paused and additional arrangements required.
We may refuse to handle waste that we reasonably believe cannot be safely or lawfully managed within the scope of the booking.
6. Materials, Plant Health and Property Protection
If plants, fertilisers, topsoil, turf, or other materials are supplied as part of the service, they will be chosen with reasonable care but are subject to natural variation and seasonal availability. We do not guarantee that living materials will thrive in all conditions, as growth depends on weather, soil quality, maintenance, and site-specific factors outside our control. Any advice given about planting or aftercare is provided in good faith but does not amount to a warranty of results.
The customer should protect or move any personal items, ornaments, fragile fixtures, or valuables before work begins. We will take reasonable care, but minor marks, surface disturbance, and temporary disruption can occur in normal gardening operations. Where the customer asks us to work close to items of value or delicate surfaces, they accept the ordinary risks associated with such work. Gardeners Sudbury is not responsible for damage caused by items left in work areas without prior notice.
7. Complaints, Changes and General Terms
If the customer is dissatisfied with any aspect of the service, they should raise the matter promptly so it can be investigated and, where appropriate, remedied. We may ask for photographs, a description of the issue, and access to the relevant area. Reasonable opportunities to correct minor issues will normally be offered first, provided this is practical and fair. No waiver of these terms will be effective unless agreed in writing.
We may update these terms from time to time. The version in force at the time of booking will normally apply to that service, unless a change is required by law. If any part of these terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect. No delay or failure to enforce a right will mean that right has been waived.
Governing Law: These terms and any dispute or claim arising from them shall be governed by and interpreted in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, unless applicable law provides otherwise. By booking with Gardeners Sudbury, the customer acknowledges that these terms form the basis of the service agreement and are intended to operate alongside any written quotation, invoice, or booking confirmation.
